Despite The Correct Verdict in the Palin v. NYT Case. There Was Media Malpractice.


 


In the reporting about the case.   Various media outlets have been ignoring the important fact that yesterday, when the judge announced he would dismiss the case no matter what the jury said, he was granting the NYT's motion to dismiss, which was filed before the case went to the jury.  And now there is this conspiracy theory floating around out there that the judge went rogue.  Shit.  Even in the NYT's own story yesterday, they buried the fact the judge granted their motion, further down the article.

And  as is often the case, people don't fucking read the whole fucking story, or do not post the critical detail.  I am looking at you ex law professor Ann.  You got a bunch of your deplorables on your blog spewing all sorts of idiotic bullshit.  Even if one of the denizens there took the time to explain Fed.R.Civ.Pro. 50. And even if today we found out the jury, who were left alone to finished deliberating, as the judge thought their verdict would be of use to the 2nd Cir.  expected to have to handle the expected appeal? They unanimously found against the whiny assed, violent rhetoric spewing, poses with guns, snowbilly.  

So there.

I do not know how good this case is going to be for the desired goal of her financers, to overturn the landmark case that established the high burden for proving defamation if one is a public figure.  I would guess the fact the jury did not at all buy her weak assed, bullshit, whiny baby, baseless  claims?   That will make it harder for SCOTUS to even go there. So we are going to have to see.  The current rogue SCOTUS is hard to predict.  But I  have no reason to believe that there are enough votes on SCOTUS to grant review, never mind change the law in a way that is all but guaranteed to bankrupt Fox News, it's imitators, and basically all known conservative/right wing media.

Now Tell Me Something I Didn't Know Before.



In HBO's "Game Change,"  Mrs. Palin is shown as  an ignorant, crazy person.  Like I knew that already.  Ok.  I haven't seen the movie yet, and would like to.  They are saying both Woody's  and Juliane Moore's work is top stuff.  But for the most part, since I saw through the thin (as in way way thin) veneer of minimal human adequacy of the real Mrs. Palin, I am not likely to learn much new here.  Particularly as the trailer shows one  of the times  she goes near catatonic.  And the reviews  discuss her bi polar-ish rotations.  She was always  nucking futs, kids.  That is not new. 

But still.  As much as I enjoy ragging on her redneck racist of the Great White North-ass, it is really the fact that there were (are) so many people in the USA more fucked in the head, who swooned over this thoroughly unimpressive, obviously no mentally fit human, that was the story for me.

Anyway, let's hope that as a result of the broadcast of the show that her reputation is now  more greatly considered questionable, across the nation.  I really can't imagine her getting to to the WH.  But at this point  that's not enough.  I want her sidelined from politics.  Shit.  I want the redneck off TV.  But then again, I am hoping Fox News gets shut down ever before her contract runs out.  But if that does not happen, I hope Fox  realizes they are better off with out her.  Anyway . . .

News flash.  Mrs. Palin is still a rube.  And her stock at FNC is so low she's mainly doing the B list shows, over on Fox Business.  I wonder if Roger Ailes and the company got their money's worth out of her contract yet?  If so, take the Redneck Xena off the air.  Please?


I am tired of the "They are not racist, but . . ." arguments.  That is not a news flash.  But I want to see some strong voices with high media profiles  make the case that calling someone racist is not impolite, as long as their behavior warrants it.  We can never really know what is in some one's heart, even if they say,"This is in my heart."  Fuckers will lie.  Particularly if they are wing nut racists who tend to believe the line is always there where the next guy said something stupid.  It is never right there under their feet, when they say something stupid.


Anything else for now?  I saw some polling showing that a race between P. Obama and Romney is tighter than one between  P. Obama and Newt.  Newt gets creamed.  It's nice to know that only so many Americans  are freak flag flying, flaming idiots.

But She Has Tits!

Poor Rick Perry. He tried to re write the rules of the debate and the usually bully meanie asshole loving GOP audience booed him! I bet he was shocked. Sarah Palin got away with that shit. But she has tits. And allegedly a uterus (even if I am not sure that either her or her brood are naturally born humans. I mean. Who's to say really with out seeing the test results?)

Anyway, some folk are saying he won the shit last night because he came out of his coma. Other's say Bachmann breathed some new life into her flaccid campaign for bringing out her scratching nails. And it looks like Insane in the Membrane Cain had a tough time of it. He got pounded on his juvenile-silly 999 plan. So there!

Speaking of Cain, I read some article about what exactly he did while serving on the board of the regional Fed Reserve. Not much. The position was at best advisory, and by that I mean not expert advisory. I mean merely advisory.

Now I will shift away from Cain. (But I will mention that if given the chance, I would love to properly indict Cain for the offense of, for intents and purposes but with out using the word nigger, calling blacks who vote Dem a bunch of stupid niggers. I mean that really. I want that whole plantation meme shit to be as vilified as calling someone flat out a nigger.)

This is me shifting. So what up Sarah Palin? Yes apparently FOX not News is still using her for her laser like insight into the reality TV show that is GOPNomPrime. But other than that? She's acting like someone who knows she overexposed herself and doesn't have much to say actually.

I hope her contract is over soon. And then I hope she retires to oblivion. Like I have said in other places if not here. If she takes herself completely off the grid, I will stop picking on her.

Thought occurred to me today, early this morning thinking about stuff (ok. I confess. I fired up the lap top for an early dose of disinformation.) Has no one made the comparison of Cain to General Powell? Powell seems to be the very embodiment of Presidential. Cain looks like what he is -- a jive talking salesman.

Now I have several ways of describing the GOP agenda. One of them is - forget about merely overturning FDR's New Deal. Lots of these treacherous, treasonous trolls want to undo the end of the American Civil War. And if they get that far -- that would be Phase Three of the Revanchist Plan, then they will try to overturn, or otherwise gut the US Constitution so it resembles some version of the Articles of Confederation. That would be Phase Four.

Phase Five would be a return to Feudalism, with Corporations as the Ruling Class. That's my thesis. There I go, using elitist, educationist big words.

Quickies . . .

Let's remember children, that the important thing to note in the debt ceiling story is that even if leveraging is nothing new in Washington Politics, the GOP leadership has so over played it's hands here, it should be considered extortion.

As of the last shit I read, Mitch Turtle McConnell floated a weird plan that pre authorises the POTUS to raise the debt limit. And of course that shit it tied to matching cuts, not revenue increases. What more reason do we need before we can arrest and deport these shits?

Moving on . . .

Some people, who will remain nameless for now, take more offense when people accuse Palin of using her looks to get ahead in the world if they are otherwise critical of her, than those fan boys who love her gams and boobies. To people who don't do this even on a dare, I double dog dare you to go read comments on her fb page. Or go out there and find a male Palin supporter and just ask them what do they like about her most? Go ahead. I'll wait for it. I know it won't take long for the fan boys to get down to it.

Lastly (for now as I want to run out now,) did you hear about the AZ state level lawmaker who pointed a loaded gun at a reporter, just in showing him the gun, not meaning to be threatening? Still what she did was so ignorant that gun people are critical. See. This is why we don't like the idea of every idiot being able to get a gun. That means idiots will have guns. And that's a bad thing.

Mrs. Palin is teasing in more ways than one. She's still teasing her minions with tauntingly seductive-trying-seeming hints that she's thinking about running (don't you just hate teases?) But in that Newsweek article she strikes poses more befitting of a Hollywood Starlet than someone seriously thinking about the very serious job of running for office to become POTUS.

Shit on a cracker! You don't pose demure, and slyly flirty if you want to be taken seriously as a candidate for leader of the Free World. Fuck a duck!

I Want to Dislike Her. But Mostly I Just Don't Get Her.

I've mentioned the blog that goes under the name The Anchoress, before. I am usually baffled by what the writer, Elizabeth Scalia, has to say about just about anything, because she is a deep, deep, deep Catholic, and seems to experience every sensation and data point through a deep, deep, deep Catholic filter. So I don't get her, usually.

And I was raised Catholic. And lots of my relatives and friends are still some shade, degree of Catholic. Arguably most are closer to being some kind of "Cafeteria Catholic." So it's not some anti Catholic thing going on with me not getting her. I would equally not get anyone from any religion who filtered the whole world through that kind of narrow, spiritual, faith based lens.

And she does talk alot about that stuff. That spiritual truth crap. Sorry. Maybe the Jesuits never got their claws deep enough into me, but spiritual truth isn't. It might be something people hold dear, and believe fully, but there's objective truth and all else is bullshit. I am not sorry to say that. I'm an empiricist. I reject alternate reality.

But enough about that for now. Let me say that she has been following and posting this story about a Catholic (not quite yet ex) priest, who . . . and I am playing here with the story, must have spent too much time down there in the Bible Belt, as he started acting like some Evan-gelly TV preacher. And by that I mean not only the TV ministry but the scandal involving sex and drugs and an ex prostitute. I finally googled him today, after skimming her latest update on him. She linked a lot of shit in her piece, but failed to author that key 'establishing' sentence so her post could make some sense to someone new to the story. Anyway, it wasn't this latest post that really attracted my interest as much as the one from a few days ago that tied in the Casey Anthony matter with the Wanna Be Evan-gelly priest.

Her observation:

"People want to see themselves and their thoughts reflected in an attractive, articulate, charismatic person, and when they find it, they feel a connection that is mostly an illusion, but which they want to be real; and they help the connection to become more real by making purchases, subscribing to newsletters and joining fan pages. One of the themes she's stuck on is her conception of idolatry. And again, this is part of her dogmatic if not spiritual filters. She sees idolatry everywhere. I do have to credit her, even if she falls short (at least in the piece) of confronting the possibility that her own spirituality, her own deep Catholicism could be a form of idolatry.

Be that as it may, I am making note of this post mainly on account of that first chunk. That's a very clear world wide truism sort of observation she makes there about false insider-ism. I will only briefly mention how I see some deliberate blurring of the Evan-gelly form of that to Wing Nut politics. That's what led to the rise of the christian Right. And it's part of what will in the end kill the GOP, eventually. That fatalist, dogmatic brand of politics can not last in a free republic.

Even if we still have Skulls Palin, Cyborg, Arctic Decoy Unit on standby. And we have Michele Bachmann, a.k.a. The Stepford Wife, officially in the race. Both are steeped in and too comfortable with that cult of personality, "idolatrous" form of evangelical politics. I really hope that that shit has reached it's high water mark and is going to continuously weaken, like the Confederacy did, every day following Gettysburg. I really hope that's the case. We don't need that kind of evil as leader of the nation.

Honestly, I did not end up where I thought I would in this post. And since I am almost a stickler for the book end gimmick, let me tie this back to Ms. Scalia. I applaud her for being able to see that the Wanna Be Evan-gelly priest has set hims self up as a false idol. Now I wonder if the right wing leaning blogger can see what I do, about how all that applies to Palin and Bachmann? Time will tell, I recon.

More about Chris Wallace's "Palinization" of Bachmann.

Again, Professor Wingnut is not the point. He's just a convenient stand in for similarly minded wing nuts. And one of the things wing nuts decry is the way the media treated and still treats Mrs. Palin. He uses the term Palinization. I guess that's the new form of getting Borked. Anyway, here are the main reasons the media ripped on her so harshly.

1. She came out of virtually nowhere. And that leads to a presumption that

2. She did not deserve to be picked as VP nominee.

3. She's a snowbilly.

4. She talks very funny. Worse than a thick Southern Accent funny. She talks crazy person funny.

5. She is a gaff machine like none other that has been on the national scene in any living person's memory.

6. Despite having been a governor, her resume was thin.

7. Because she came out of nowhere, everything about her was dug up pretty fast and made public for the first time within a short period of time.

8. Her family is a disaster/real life soap opera/was a reality TV show before they were getting paid to be on TV.

And Lastly.

9. Even if she might not really be as stupid as some of us like to say, she obviously can not think on her feet and respond well to unexpected questions. So she comes across as profoundly stupid.

And she's got that freaky religion, and her anti elitism not only is a slap in the face to the media (ya, that's smart. Antagonize the press like that,) but it makes her the worst of snobs. It makes her a redneck snob.

Wingnuts will deny most if not all of this. But all that shit is her shit. She makes it very easy for the media to treat her more like a freak show than a serious player.

Back to Bachmann, Wallace, and Professor Wingnut. I sort of remember that he had the update on his post last night that Wallace,"has issued a video statement acknowledging that it was a mistake to have used the term “a flake.”" And the Professor then says Wallace is a class act. Excuse me?

The Professor originally laid out the case that Bachmann was being Palinized, and then calls Wallace a class act for merely taking it back? Like I said last night, The Professor is pretty stupid if he does not understand that that was no accident. Wallace likely pre planned that question, as a bit of deliberate theatre. He had his own reason for taking the shot, never mind that the other well known Tea Party Queen is still an employee of Fox News. He got the effect he wanted. He gets to say, hey. I can punch at the republicans too. And he gets to apologize for it, after being pressured. It's still a win for him. Not classy, that. It's cunning, though.

Wallace is likely the smartest person on the payroll there who's "on air" talent. I suspect he's not only gaming the system generally, but he's gaming his bosses.

No wonder he's spent so much time trying to equalize himself and Jon Stewart. He keeps forgetting that if his act is really that, an act, it's still supposed to be a secret. He's in showbiz in his own mind. And he's playing the part of wing nut journalist. But he's still being graded under and classified as a journalist, not a performer. Ok. That's my take on it.

And a couple things before I find the door. Wing nuts like the professor just don't get it. They don't get it, that not only is politics a big game, but Fox News, for all they like to be the right wing partisan network, basically holds their audience in low level contempt. They try to game the game as well as they can, and that means they game the audience on a regular basis. And make a shit load of money that way. Just look at that all knowing smirk on Chris Wallace's face for the tell.

Oh. And one other note. And this might be how Bachmann falls off the wall like Humpty Dumpty. Even better than Palin, Bachmann can work well enough with prepared remarks (as long as she doesn't have any of that stupid shit in her pre prepared remarks.) But as well I suspect she will fail the improv test. Back in the days when she was saying all sorts of stupid assed shit, if not totally bullshit and lies, she likely was speaking off the cuff.

But she's been well rehearsed lately. We got to get her on the fly and try to make her think on her feet. If she's been well enough coached, she might not take the bait though. We need to give the shiny thing something she can't resist as a shiny thing, lure. Then we will see the real crazy person. She's not buried that deeply. More so in the interview she did with Bob Schieffer than Wallace, she started to let her freak fly, when she started talking about her religion. She held back some, but just like Mrs. Palin she's done some testifying before the congregation. And when she lets her freak fly its almost as freaky as Palin's tape was. If I find it again, I should post it.

Granted. This does not mean we can now comfortably guess she's staying out of the race. Ya never know with her. She seems to just do shit randomly. Granted, that would be a lousy trait to have in a POTUS. But you know there are some batshit crazy wing nuts who would argue that point.

Anyway, where are those people who were predicting she was outsmarting all the critics? Where's the people who were saying Mrs. Palin was breaking all the rules; that she was going to redefine how campaigning for POTUS is done?

Hopefully they are off getting psych tested. Neurological testing, too. Pays to cover all bases, all that.

The Palin Data Dump. So Far, No Excitement . . .

Shit. The spin her supporters have been unleashing has been more interesting as in telling, than the actual emails. They would want the world to believe this shows her as an engaged and competent governor, performing her duties.

Now I am jaded, but what I see is someone of average intellect, at best, lost in the petty details one would expect some small town mayor to have to handle. And her immaturity and obsession with self image as her favorite thing, shines brightly as a bonfire of vanity.

It really does not seem to portray a serious governor seriously at work. But again, that's the point. Now one does not have to be a true multi disciplinary policy wonk to be a gifted governor. But this shit is so far from that it is funny that some people still think this is evidence of anything beyond the Peter Principle explained through real world example.

And the oil and gas shit? She's no 1/2 wonk on that shit either. That was already known, however. She grasped the issues there about well enough to have an idea what she hoped to do, and how to exploit all that for her career. Instead of the bridge to nowhere, we should have been talking about the invisible pipeline to nowhere.

For some reason I have that line from Sunset Strip in my head, about how the pictures got small. But in Palin's case, she the small thing.

And even if taking that class in Fundamentals of Costume Design was a dreary experience, and the professor ripped me to shreds on my presentations, that was not on account of lack of skills. That was on account of not feeling it. Still, though. I learned that craft. So when I say the following I am saying it as a formerly professional general theatre artist.

I wonder how long it took them to find that helmet that just so perfectly allowed for the fringe of bangs up front, and maximum hair flow, in the back? If they found it fast they were lucky, but I am damn sure choice was made based on how it looked.

So there.

Still, I don't get the fan boys. On her best day she rates a B-. I know. I grade hard. I've lived in the NY City area for most of my nearly 50 years, and I am used to cutting across the Garment District and seeing actual fashion models all the time. The low rent snowbilly does not rate. And she has had so much work done that I don't really see a face there. I see either the work, or the skull, or some creepy vision of both.

Palin's Taking a Bus Tour. Should Anyone Care?

Before I go any further, I must confess that I mentioned this yesterday on my FB page. I'm kinda thinking it might be more likely than I ever thought before, but I am still sorta hedging my bet whether or not she's running for POTUS. At the least, news of this tour gave me a chance to knock her and her ability to fuck things up, particularly when she goes of script. (Now I am assuming she will have a script for her stops. Question is will she stick with them or not?)

But I read today (noticed the art. on Mediaite last night, though) some interesting opinions from Lawrence O'Donnell. His take on the situation was to lay shame on the media, particularly the NY Times, for falling for that shit. Again. Remember Trump? (I swore off using that flim-flam-racist-man's name, but he is out of the race now, mostly.) Not really a digression, but linked idea, I read some other article accusing that loony sheriff Joe Arapio of being more concerned with PR than proper management of his department. So I guess my point here, is maybe the question of the day should not be whether she's in the race, but instead, how should society deal with ego centric, collossal attention whores?

(Yes I know in the post slut-incident world, we need to be mindful, but the term attention whore or ho is universally understood to be gender neutral.)

But ya. That's my thought of the day, based on this latest installment of the Mrs. Palin saga.

Should we turn our eyes away until she does something actually truly newsworthy? That would be best for us, I recon. But we do like the shiny thing more than the dull thing. See how it sparkles!

Well It's Not As If Mrs. Palin Has Given Me New Cause to Call Her a Racist, Exactly, But . . .

It's pretty close. According to the report, she took David Gregory to task for calling out Newt on Newt's racist dog whistle. According to her "logic" one white person calling out another one for employing despicable racist dog whistle rhetoric, is itself racially tinged and/or racism. What the ever loving fuck!

But as I suggest in the custom headline there, the cat is out of the bag. I have been predicting that the GOP, this election season, will sink to all time new lows of shittyness. And if this is the tactic for now, to race bait, and then, like the grammar school playground rubber/glue thing call 'racist' those who call them out on that shit, they have already (in this one example) reached a new, execrable, and record low.

But for some time now I have been saying there is a sorta almost organized effort out there, in the rednecky part of the right wing, to do their best to weaken the word and the idea of racism. Weakening the meaning of the word, the idea of what is racism helps them get away with all kinds of ugly racist shit. And Mrs. Palin is clearly part of that plan. Oddly enough, that runs counter to the other thing they do. That is when it's one of them caught in an obvious racist slip up, they will strain all credibility to narrow the standard meaning of the word to try to move the offending act/words outside of the definition. Basically, they will do and say anything to avoid taking responsibility, or even just catch up to the rest of us with the understanding of what is and is not socially acceptable for civilized adults in the 21st century.

And the election is more than a year away, kiddies. They are not even warmed up yet.

And yes. I am going there. I am going to talk about her looks. While I consider just about anything other than that modified Mullet she is famous for, the poofy on top thing, an improvement, I am puzzled with the new do. It's sort half "That Girl" and half Middle Age Republican Matron Helmet Head. I think she was going for the latter. I think it would be such fun if she tried out a proper Margaret Thatcher "Bouffant Terrible." (Thanks to Rhys Hughes for that description.)
