The Dangerous Defamation Judgment Against Oberlin College: BY JOHN K. WILSON





An interesting essay on why the ridiculous verdict in Gibson v. Oberlin College is, for lack of a better description, "Fucked Up and Bullshit."  I agree with the writer that what ever bad conduct was directed at the plaintiffs, it definitely was not standard defamation.  I was actually thinking yesterday, is it really defamation to be called a racist?  I mean really?  Save when it is a accusation tied to misconduct, unlawful, prohibited discrimination (and properly filed pleadings are privileged if I recall correctly?)  I know a lot of people fear being called racist as much as reasonable people fear getting a chronic disease.  Others just don't give a fuck, or just throw the accusation right back at who ever called them that.  But it is usually just somebody's opinion, I think.



But I really think the judge committed reversible error in not kicking the whole case out on motion for summary judgment.  And like I said in my last post, the theory of harm and damages was just bananas.



Now I finally got the answer to my question, why was there no defense of truth, or evidence at trial about whether or not Gibson's has a reputation at least among not white folk, of being racist?  Turns out I learned, over on the Althouse blog earlier today, that the judge specifically prevented the defense from introducing any evidence of that.  Basically the judge took away what is one of the standard defenses to defamation; truth.  So we have reversible error at the trial as well.  I don't think this judge's reputation will survive unscathed here.  And the idiotic reason he excluded the defense as a whole and testimony regarding that matter was because the kids in the original incident that caused this shit show said they were not victims of racism . . . when they plead out on much lesser charges, thereby avoiding felony convictions.   Never mind that aspect, but since when is a statement made in relation to a plea bargain, that has no bearing on the criminal charge, a finding of fact binding other cases?  Ohio law might be weird, but not that weird, I am guessing.



For either of these reasons, the appellate court can vacate this ruling, even if they really are doing it as a public policy, institutional level, can't let this shit stand, sort of reason, actually.



And the part that the appellate court can not dare talk about in a court's opinion, is the sick, twisted politics at work here.  Just as much as on the conservative blog where I first read about this case, the peanut gallery over at Althouse's blog were hailing this as a critical win in their idiotic Culture War.  Because them SJWs and liberal eggheads on those out of touch college campuses are way out of touch with "normal" folk.  So the rabid conservatives say.  Shit.  Even one yokel posted some psychotic quote about how all of them want to kill all of us.  Pretty sick, seriously disturbing shit.



Parting shot (pun not intended.)  If a well traveled blog like Althouse was held to the same standard that the judge and jury held Oberlin College to, the owner would be open to all sorts of liability based on the putrid shit some of the visitors post.  Good thing that is not the case and the law.  Yet.

Sorry You Anti SJW Assholes. The Verdict in Gibson v. Oberlin College is Fragile, if not D.O.A.

Gibson v. Oberlin Verdict can Not Be Allowed to Stand.


I have been fascinated with this story, since I first learned about it.  In sum, a local bakery/store near Oberlin College was boycotted and picketed by students, after some students got caught shoplifting.  Part of the complaint about the business was that they were racists, and had a history of racial profiling.  That kinda shit.  Now, for awhile, the school stopped doing business with the bakery.  But then they started doing business with them again.  Then the bakery sued the school.  And that is one of the most important parts of the story that often gets left out.  The real reason Gibson's no longer has any of the college's business, is because they sued the college, and the college cut off the spigot.

The essay I have linked here is a good fact based argument as to why the verdict should not be allowed to stand.  And here, I will say why I believe the first appellate court and the following one or ones  (I don't know shit about Ohio's judiciary) should throw out the verdict.  As the writer of that essay  says, this verdict leaves all colleges and universities open to suit for what is really student conduct.  (In Ohio at least.  The case is only precedent in Ohio.  And there they have a weird but not perhaps unique allowance to sue based on aiding and abetting  defamation.) 

And who would be most at risk in Ohio if this ruling is allowed to stand?  Why that would be the people of the Great State of Ohio!  The University System of Ohio has over 500,000 students these days.  So will the appellate courts  leave the State open to suits like that? I don't think so.  An unofficial part of the job of being a judge in the state system is,"Thou shalt not cause the state to lose money if it can be avoided."  And let us describe the nightmare scenario.  Not only can butt sore townies sue, or invited speakers to campus, but in the age of the Internet, anyone, anywhere could file a suit against The University System of Ohio, if they say they were defamed and some student used school property to allegedly do so (like the servers that connect to the Internet) in their protest, or boycott, whatnot.  And that is a lot of exposure for the State.

But wait, there's more.  There is the other downside to letting the verdict stand. The University System of Ohio would have to crack down on students' 1st Amendment protected speech.  So that means exposure to more lawsuits that way too!

I am sure the trial judge and the jury felt sorry for the Gibsons.  But I fully expect the higher courts to say, sorry kids, you don't get a penny.  It's not that appellate courts do not care about individuals.  But it is not their job to give a fuck about that shit;  their job is to view things from the institutional level.  And a precedent that leaves The University System of Ohio, and all other Ohio colleges with their cheeks spread wide open is something that must be overruled, from the institutional view.

Now there is some other tangent I will only mention.  And that is the Anti SJW crowd loves the verdict here, because  they love the idea of sticking to those people.  And the college administrators  might have been assholish here.  But that by itself is not a tort.

And now I will make my last point.  At minimum I expect a higher court to void the damages award.  They should, truth be told, rule that the trial judge erred in not granting summary judgment on all counts, before letting this shitty case go to a jury.  But at minimum, the argument for damages was ass backwards.

Oberlin College aided and abetted some of it's students defamation of the Gibsons.  And then for a while, based on the defamation Oberlin College aided and abetted in, Gibsons lost money they should have earned from continuing to do business with Oberlin College.  Never mind the fact that Oberlin College later resumed doing business with the Gibsons. Oberlin College finally stopped doing business with the Gibsons after we, the Gibsons  sued them.  So give us millions of dollars.

Professor Racist Dickface at it Again.

I started off calling this repellent piece of excrement, some wingnut law professor.  But he got more vile in a short period of time, so I started calling him professor racist dickface.  His real name is  William A. Jacobson, and he has a hard on (metaphorically) for Elizabeth Warren.  Because he's a wingnut, dick face, douche.  And he has launched a crusade again her based on the dubious claim she's been practicing law with out a license.  What bullshit. Particularly as he is a law prof himself, he knows full and god damn well that profs get a explicit or sometimes implicit waiver to consult and even help out on briefs, while they are profs.   With out necessarily  being admitted to the bar of the state in question.  I think I learned that shit in the first year of law school if not earlier, watching "The Paper Chase" on TV, or something.

Now why would a law prof do this?  Go all bat shit against custom and practice, beyond blind, douchy partisan hackery?  He's a wingnut law prof.  Most of the faculty  at his school not only likely despise him on account of his odious politics, but I would have to guess,  his stench-foul personality.  Same goes for the rest of the nationwide law faculty  congress.  Most think republicans  are the stinky shit in a fully used baby diaper.

So I am guessing. As that is all I can do.  And this is my guess and an opinion.  He had nothing to lose in going so ugly-stupid, bat shit nasty against one of his peers.  So there's not even the savings grace of any bravery here.  He's like  the most despised faculty member in the teacher's lounge.  Who farts sinkers, and steals other teachers lunches when he can get away with it.  Because they don't like him, so he's feeling entitled to be a little petty shit bag, in defiance of his being disliked for nothing more then being the shit of a creature he actually happens to be.

Again, just my opinion.  And I generally despise GOPers  so that's my bias at work, you may argue.

Last Night's Debate, Oddly Enough, Accurately Described by Some Wingnut Law Professor.

Make no mistake. I despise the man I call "Some Wingnut Law Professor." Firstly he's a partisan wing nut hack who lacks the self awareness that he is a political hack. In the same vein, his political analysis is as valuable, usually, as a randomly selected 6th grader's explanation of how the Derivatives market works. I will be blunt. He usually doesn't seem to know what the fuck he is talking about, when it comes to politics. He's immature. Bratty. Whiny. A Right Wing Concern Troll (particularly where that Snow Billy Grifter Palin is concerned.) And he thinks he's clever. In that pathological way that wing nuts think they are funny and really are not. (And that's why there have been so few professionally successful right wing comedians or humorists, or comedy movie/play/TV screenwriters. But I digress . . .) He basically sucks. And visiting his page is rubber necking for me.

Anyway, today was his broken clock day. He actually was a little clever and actually was far more insightful than he even realized, I am sure. I will have to explain that down stream. But to set it up he did this "cute" review of last night's debate by matching the GOP candidate to lyrics from "popular" American songs that might best represent their view of how they and or the rest of the debate went. Now let me get to the zinger, the unintended insight professor wing nut achieved here. But first let me say his "cute" suggestions for the song lyrics were borderline clever in their own right. And I would say the literary device was all by itself likely the first time I saw him do anything remotely clever. But here is the unintentional brilliance he achieved. In employing that device, in doing a rather good job of matching pop tunes to GOP candidates, he makes the case that this batch, individually, and as a group, has to be the most trivial, un serious batch of GOP Hopefuls in decades, if not ever. By extension he makes the point that the current state of the GOP is now more trivial, and un serious than it has ever been.

And for the coup de grâce. He is implicating himself as being most trivial, and un serious. After all, he is a wing nut himself. And he did not get how deeply cutting his remarks were. That is unless he intended to indict the whole GOP Conservative movement as most trivial, and un serious, and in doing so, himself.

Game. Set. Match. Way to defeat your own self, professor.

What's The Best Entry Point for the Death of the Bachmann Candidacy (she's got serious brain problems, ya know) story?

Some wingnut law professor. He is giving her the benefit of the doubt (cause politicians never lie about their shortcomings, and other embarrassing shit.)

Fuck a duck. There's migraines, and then there are incapacitating migraines. If the ex insider reports are only 1/2 true, The Stepford Wife is in my opinion, medically unfit for the office of POTUS.

I had what was one of my busiest threads on my fb page today over a post about that shit.

To explain my own bias, I assume The Stepford wife is not only a pathological liar, but a hypocrite par excellence. I give no benefit of the doubt to trash like her. Instead I embrace every worst negative inference. So I am assuming the worst those ex insiders say is true. And due in part to the push back I got on my fb page from some GOP (friendly leaning) friends) I did the minimum research on the meds. Short of it? There are some preventative drugs. But then there's the post onset drugs. One class of them is not really incapacitating, but still works as a Serotonin inhibitor, so it's a truly serious kind/class of med. And the other is opiates. You don't need me to explain opiates, but to say the are the dopest of Dope.

And I assume based on the reports so far, she needs the opiates. She got a very bad case of bad head. if she needs to take opiates, then she's medically unfit for POTUS. If the people in her district continue to vote her in to Congress. Fine. But the Stepford Wife fails the Medical Fitness test to be CIC and in charge of the launch codes.

Her campaign? I can't swear to it but I am thinking it's all over but for the whining.

Shit. The fucking useless press, far as I know, have not yet asked if her husband has been treating her. Ethical violations there, Mr. Bachmann. And yes I think you are that fucking stupid. Arrogant. Both.

It Was the Best of Times. It Was the Worst of Times.

The suicide by graft and crime of NewsCorp, starting with it's UK Print Ops, and perhaps leading to loss of the broadcast license in the USA (among best case scenarios) gladdens my heart. I would be full of the joy of seeing the universe correct itself, meting out justice to those who got it coming. However, the on going debt fight in DC still has me distressed and way angry.

Speaking of that, the news of the day is not Eric Cantor's dubious claims about an angry P. Obama storming out of a meeting (I would have been pleased about that if that was something I truly believed, by the way.) But it's the bit about how at least one GOP Senator is now thinking and saying out loud that the extortion scheme (my phrasing of it) tied to the debt limit fight might not have been such a good idea.

Bob Corker Has An Epiphany.

I do believe in giving credit where due. Now on to some criticism.


To some wingnut professor. Are you out of your fucking mind, pimping Cantor for VP? Here. Fighting the good fight? Are you out of your fucking mind? And this wingnut professor posts some audio of Cantor blabbing about the details of the negotiation as his evidence of Cantor fighting the good fight? Fuck a duck! The mere fact any of those evil bastids went along with this extortion plan is well . . . evil! (I know that wing nuts have trouble with facts, reality, and the fucking obvious. Using the issue of raising the debt limit as an extortion fulcrum to jack the White House into agreeing to things that they and the American People do not fucking want, is inherently evil, no matter how much people may believe in Reaganomics. And we all fucking know that fucking doesn't work. Sorry. Like I said above, this shit makes me angry.)

Now I have already highlighted someone at least on the path to good work, Sen. Corker, who is at least doubting, publicly, the extortion plan. Anyone in the GOP still thinking and playing that game as if it is not evil, is evil. Again. This shit is fucking obvious!

Let me find the door. I tend to stay calmer about this shit merely reading about it, than typing about it. It must be that when I am thinking about my comments, and analyzing the process and what it means, that must wake up deeper parts of my brain. And before I know it, I go all fuck this fuck them. I know it's not necessary to do so. But hey. My blog. My thoughts. All that.

Is it Time to Resume GOP (or Shall We Call it Wingnut) Racist of the Week?

Here's the timeline, far as I know (with out actual times listed.)

First, some article gets posted over at The Daily Beast talking about how there are (have recently been) at least 9 clearly out of the closet white supremacists running for office on the GOP line.

Some people would say that's 9 way too many. But not Professor Wingnut. I am not going to call him a racist for merely overlooking the fact that 9 is way too many, and instead doing his dumb-assed victory dance claiming, in so many words, the number is too low to bother to take note (as the peeps at The Daily Beast did.)

And not that the practice of forming up a daisy chain, smelling each other's asses, and proclaiming their ideological cohort's farts smell as sweet as roses is unique to the cult of right wing bloggers, but this is yet another instance of that. Ann Althouse links Professor Wingnut's 180 degree wrong remarks on the Daily Beast out of the closet GOP racist story. I am not going to call her a racist on account of that. But some of her minions? Her commentariat can get ugly and fast, but some of the comments there were just sickening. But that is often the case.

I would make some remark that what we are seeing is the normalization of low level racism on the American Right. But that's not new. We are just seeing a newer version of it. And that even is not that new, but has been forming since the late 60s early 70s when out of the closet racism became a rare thing. And that used to be the norm here in America, not too long ago.

In our current America, wingnut racists for the most part deny they are racists, while clinging to their racist thoughts, and calling other people racists for really stupid things like acknowledging the social reality of race. Ya. I have seen it done time and time again, that if a Democrat merely mentions race, like that one time P. Obama mentioned he himself was black? You know what I mean. It's fucked up out there. And people like Ann Althouse and Professor Wingnut clearly are not part of the solution.

9 out of the closet racists running for office across all of America on the GOP line is way the fuck too many. I mean really! How many more do you need to see before you see a fucking problem with it?

Oh. And before I end my latest wingnuts as racists rant, did you hear about the asshole tea bagger racists selling "Yup. I'm a Racist," t-shirts at some rally? They are tired of being called racists. So they made up a shirt saying they were racists.

If that was meant as irony, I would call it the ironic equivalent of a suicide vest. Way not to make the point, doods.

Back to Some Wingnut Law Professor. He Found a Negro Palin-Head.

Astounding! Not.

Talk about a perverse delusion. Granted, white GOPers outnumber black GOPers by what? 63% to 2% of the whole party, according to Gallup. So if there are (an itty bitty tiny amount of) blacks in the GOP, the mere existence of one who likes Palin is just a yawning event.

And forget Palin. Hey Professor Wingnut. Did you happen to forget the negro man running in the GOP Primary? Ain't that the more important thing? And he's not the first.

Speaking of 'not the first,' if you follow the link to Professor Wingnut's page and look at the first article he links, you get to read the incredible story about how this black lady got all into Palin because her little daughter saw Palin on the TV. The little girl is said to have said something like she did not know a girl could become President. I call this incredible, and by that I mean doesn't pass the stink test. Um. Hillary? Remember her? I read that the first time and just glassed over on account of the vapidness. On my second pass, I deconstructed it and came to the conclusion that I don't give a fuck what anyone else says. That looks like scripted bullshit to me. Nanook of the North level scripted bullshit.

More about Chris Wallace's "Palinization" of Bachmann.

Again, Professor Wingnut is not the point. He's just a convenient stand in for similarly minded wing nuts. And one of the things wing nuts decry is the way the media treated and still treats Mrs. Palin. He uses the term Palinization. I guess that's the new form of getting Borked. Anyway, here are the main reasons the media ripped on her so harshly.

1. She came out of virtually nowhere. And that leads to a presumption that

2. She did not deserve to be picked as VP nominee.

3. She's a snowbilly.

4. She talks very funny. Worse than a thick Southern Accent funny. She talks crazy person funny.

5. She is a gaff machine like none other that has been on the national scene in any living person's memory.

6. Despite having been a governor, her resume was thin.

7. Because she came out of nowhere, everything about her was dug up pretty fast and made public for the first time within a short period of time.

8. Her family is a disaster/real life soap opera/was a reality TV show before they were getting paid to be on TV.

And Lastly.

9. Even if she might not really be as stupid as some of us like to say, she obviously can not think on her feet and respond well to unexpected questions. So she comes across as profoundly stupid.

And she's got that freaky religion, and her anti elitism not only is a slap in the face to the media (ya, that's smart. Antagonize the press like that,) but it makes her the worst of snobs. It makes her a redneck snob.

Wingnuts will deny most if not all of this. But all that shit is her shit. She makes it very easy for the media to treat her more like a freak show than a serious player.

Back to Bachmann, Wallace, and Professor Wingnut. I sort of remember that he had the update on his post last night that Wallace,"has issued a video statement acknowledging that it was a mistake to have used the term “a flake.”" And the Professor then says Wallace is a class act. Excuse me?

The Professor originally laid out the case that Bachmann was being Palinized, and then calls Wallace a class act for merely taking it back? Like I said last night, The Professor is pretty stupid if he does not understand that that was no accident. Wallace likely pre planned that question, as a bit of deliberate theatre. He had his own reason for taking the shot, never mind that the other well known Tea Party Queen is still an employee of Fox News. He got the effect he wanted. He gets to say, hey. I can punch at the republicans too. And he gets to apologize for it, after being pressured. It's still a win for him. Not classy, that. It's cunning, though.

Wallace is likely the smartest person on the payroll there who's "on air" talent. I suspect he's not only gaming the system generally, but he's gaming his bosses.

No wonder he's spent so much time trying to equalize himself and Jon Stewart. He keeps forgetting that if his act is really that, an act, it's still supposed to be a secret. He's in showbiz in his own mind. And he's playing the part of wing nut journalist. But he's still being graded under and classified as a journalist, not a performer. Ok. That's my take on it.

And a couple things before I find the door. Wing nuts like the professor just don't get it. They don't get it, that not only is politics a big game, but Fox News, for all they like to be the right wing partisan network, basically holds their audience in low level contempt. They try to game the game as well as they can, and that means they game the audience on a regular basis. And make a shit load of money that way. Just look at that all knowing smirk on Chris Wallace's face for the tell.

Oh. And one other note. And this might be how Bachmann falls off the wall like Humpty Dumpty. Even better than Palin, Bachmann can work well enough with prepared remarks (as long as she doesn't have any of that stupid shit in her pre prepared remarks.) But as well I suspect she will fail the improv test. Back in the days when she was saying all sorts of stupid assed shit, if not totally bullshit and lies, she likely was speaking off the cuff.

But she's been well rehearsed lately. We got to get her on the fly and try to make her think on her feet. If she's been well enough coached, she might not take the bait though. We need to give the shiny thing something she can't resist as a shiny thing, lure. Then we will see the real crazy person. She's not buried that deeply. More so in the interview she did with Bob Schieffer than Wallace, she started to let her freak fly, when she started talking about her religion. She held back some, but just like Mrs. Palin she's done some testifying before the congregation. And when she lets her freak fly its almost as freaky as Palin's tape was. If I find it again, I should post it.

Hey Professor Wingnut. I Tell People I Can't be a Monster, Because I was Already a Darkling.

That shit likely doesn't make sense to lots of people. Fans of Lady Gaga are known as monsters. Fans of the lesser known yet devoutly loved (and way more interesting, edgy) Shirley Manson are known as darklings. My excuse for not being a Gaga monster is my being a darkling before Gaga blew up on the pop scene. And I love her look and sound and all that shit more. Sorry. The Gaga act really doesn't put the lead in my pipe.

And in that vein, law professor wingnut? Don't you fucking get it? Maybe Sean Hannity considers Bachmann his honorary Congress Critter. But for the most part, expect Fox not news to stay stiff and drippy for Palin (even if she is not in the race, and they are being passive aggressive with supporting Palin, somewhat in some circumstances.)

Chris Wallace may have been pursuing his own agenda. He did, after all, use his attack on Bachmann as evidence for his being balanced. Following his being so soundly bitchslapped by Jon Stewart last week. And Geeze Louize. For a republican to eye fuck he picks Sarah Palin's rival? As a fem con with prezzy nomination ambition she's an easy target. She needs them more than they need her. Word!

Hey professor. This time I am going to say yes you are that fucking stupid if you can't see what is going on here. Palin is the filly in the Fox Stable. Bachmann is the insurgent, the challenger to the title of Tea Party Queen.

Are you really that fucking stupid not to get it that for now, Fox has decided on who is the wing nut beauty queen?

Dude. It's one thing to cling to your ideology and dogma and biases as tightly as your guns and your bible. Shit, it's one thing to do so to your ideology about guns. It's another thing to go all passive aggressive Mean Girl Troll about it.

Professor Wingnut still can't just come out and say something like a direct insult to someone who dares hold a different opinion than him. He has to go all chicken shit and insult the idea and not the person. I know that is how it's done when one is writing the dissent for a SCOTUS decision. But this is the real world, fool. See how I did that? I just went right ahead and called him a fool. No fucking around with shit from me. I will call a fool a fool and not give a shit about it.

Now for his stupid shit post.

So says Professor Wingnut. So I am once again in the position of having to say . . . do I really think this fool is that stupid? Of course not. But he's a wingnut. And he really has a low opinion of anyone who dares have a different opinion than he does, but he never seems to be able to just spit it out. He does it the pussy way. Calls the attack very bizarre. Fuck me. Calling that . . . argument very bizarre is the only bizarre thing going on here. Again, Professor. Just go ahead and share your real feelings with us. Trust me. I hold you in contempt already. So just let loose will ya?

Anyway here is the break down of the issue and why the professor's remark is bizarre if anything here.

In the vid the professor is posting about acting Chicago Police Superintendent Garry McCarthy makes the argument that racism is part of the reason that guns are flooding urban areas and killing black and brown youth. Actually he was talking about the Federal laws that allow for that. Now it's one thing to disagree with him. Fair enough. But to call that very bizarre is itself bizarre mainly because that's not a new argument. I think I have been hearing similar things since the shit hit the fan in America with the drug trade, back in the 1970s.

Let me catalogue it. Over the years I have heard arguments that the illegal drug trade is a product of racism. Likewise the anti drug laws are said by some to be racist. And that leads (as some have argued) to the argument that our current "Prison Planet" penal system is also racist. And the flood of guns, which is tied in with the otherwise racist drug related shit, would have to be racist too, according to that logic.

And that case has been argued for years and years. Disagree with it if you must, but as far as sociopolitical theories goes, that one has some grey hair by now, professor.

Oh. And I remembered this lawsuit from a few years back. The NAACP basically made the same argument about guns and racism there.

And there is another reason that calling McCarthy's statement bizarre is itself bizarre. Not to a man or woman, but many many many cops are all for more gun control. That might be on account of incidents like McCarthy mentions in that vid. And yes, part of that is on account of the fact lots of those guns are pointed at and shot at cops. Cops don't like that shit, professor. It's bizarre not to see that as normal, even of one doesn't favor gun control.

Oh. One more shot (pun intended) at Professor Wingnut. He's something of a Sarah Palin Fanboy. Now as embarrassing as his recidivist, wingnut, illogical if not fallacious aguments get sometimes, the fanboy shit is really juvenile. So McCarthy was not happy seeing your little sweet cheeks Saint Sarah on TV screeching in her chipmunk on crystal meth voice about the beauty of 2nd Amendment Rights, after yet another day on the job seeing kids shot up if not shot to death. I for one have no problem getting where he's coming from. But anyone who speaks ill of Saint Sarah will have to face your loyal fanboy wrath?

It's kinda sick, and a little creepy, this Palin fanboy shit. I mean really!

It's as if Them Wing Nuts Live in a Bizzaro Universe.

Back to trashing that wing nut law professor. He's a Class A Wing Nut. And by Class A, I mean he's light years beyond merely having an ordinary partisan political biased point of view (I resemble that myself.) He seems to not only deny the existence of other points of view, except in showing contempt for such. But to make matters even worse, he does that particularly despicable (if you love language and communicating in an adult world of ideas) shit lots of wing nuts do. And that is either play the redefinition game, or otherwise ignore the plain meanings of words, if not established, objective reality on the very planet.

And since there's a feature here of a silly-assed stupid shit headline, let me make a more accurate one for his post on his blog.

I read the whole account. And as far as accounts go, it not only is clearly meant to be a personal account of a person's personal experience, as opposed to a white paper on The Lingering Effects on the Intifada, Under a Croatian Christian Nationalist Perspective. Or some other such academic shit. I found her account to be a very interesting read. She tells an interesting story, I am saying. And even if I have a better than average span of attention, I bore quite easily. When shit is boring. Or badly written. Or god forbid, both.


Now do I think he really doesn't understand the meaning of the phrase "Personal Account?" No. But I know a lame, passive aggressive insult when I see one.

What I see here (there) is this. This asshole doesn't agree with her politics, and her change from being a knee jerk Zionist to someone no longer a knee jerk Zionist. So he launches a weak-assed insult at her. Now remember kids. This is the juvenile who did a victory dance (well, used a cartoon character in simulation) for what was basically the obvious guess about the result of the Wisconsin court case about the procedural challenge to the Kill Collective Bargaining law. Maturity ain't his strong suit, apparently.

And ironically this stupid (acting as I know he isn't really a stupid person. I'm just taking delight in insulting him) asshole goes off on a mini tangent about the writer's use of that hallowed, revered, Eff Bomb to Top Them All, Motherfucker. This, after his weak-assed passive aggressive insult, shit.

Now I am really not at all inhibited in using the work fuck. I like it. It conveys a lot of emotion in just four little letters. Motherfucker is fuck on crack. I don't use it much, but I respect it's power. I respect it's authority as the Big Daddy of insults. And that is what I am really talking about here. Being honest in being insulting.

Not to say I never get creative about it. Sometimes I will go to Babelfish and translate insults into French because, as that character in the Matrix movie says,"I love cursing in French. It's like wiping your ass with silk."

But still, that passive aggressive shit is so trollish. Remember those posts I made a week or so back about how Mrs. Palin (and many wing nut women) is a passive aggressive troll and a Mean Girl? Ya. This is exactly the kind of trollish mean girl shit I was talking about.

Now I can't make anyone stop acting like a Mean Girl, passive aggressive troll. But I can point out the fact that that is some motherfucking weak shit.

Let's Pick On A Different Law Professor for a Change.

Don't remember his name. Don't care. Anyway this guy is a conservative, and we all know there is no excuse at all for that kinda shit! None!

Anyway, I guess he's popular in that strange clique of right wing law professors.

Now the reason I am bothering with this for a post is I am ignoring Weiner's resignation. For now. But seriously. He posted some weird own back-slapping post about how he predicted the result in the WI Union Busting case.

Ok. Well kudos to you. (That's meant as sarcasm.) Given the politics of the situation, and that lots if not most people would have bet that outcome, doing the Smurf dance over that one is sorta disproportionate to the alleged victory.

Anyway here's the sick little follow up. Here.

I call it sick because after the first self back-slap, he got a comment from some visitor tsk tsking him for "spiking the football," and in doing so, not coming across as dignified as one might expect from a law professor. His reply to that was adding the stupid little dancing cartoon critter vid. In of itself, that's not really sick. But getting all excited over that guess (since it really was a low hanging fruit kind of thing, really) is as excessive a thing as an elaborate End Zone dance by a pro football running back who plowed through a line of Pop Warner kids, to make the score. Shit. I am pretty sure I have seen such a thing (by analogy) in some comedy movies. Or episodes of The Simsons. Likely both.

Now if he had picked the trifecta for all three legs of the Triple Crown? Ya. That would be impressive. Shit. Even picking the trifecta for one of the legs would generate genuine kudos. But this shit? Let me try another analogy. It's like stealing candy from a baby and then declaring oneself to be a criminal mastermind.

It's sorta pathetic, actually. Even if meant as funny. Still sorta pathetic.

But hey. I did say he was a conservative. I am not going to say all of them are like that. But most seem to have complicated alternative realities. Seems.





And YES. I have seen that Weiner is out. I am sorta sad to see him go, mostly because he was so effective at sticking it to the GOP pig-dogs. And of course, that's why he was targeted by the pig-dogs. And since he did not really make any friends there in Congress, seems he had to stand alone. Guess that's a harsh reality to have to own up to. So now that this thing (seems to be) is over, I will admit this much.

I over played the "they are ratfucking him" line, early on. Little did I know then, that he had made it so easy for them to get him (a Clinton sized ego for a lesser man, seems.) It was as if he placed the "Kick Me," sign on his own back, for crying out loud. He made a series of mistakes that rate up there with Gary Hart!

But I am particularly saddened that the GOP pig-dogs get a congressional scalp, not for official misconduct, but for what is essentially the non-crime of being a hetero male with a pulse, a twitter account, and a fancy phone, and the bad judgment that often goes with that territory. Ya he lied. But most people are dishonest (or at least not exactly forthcoming) about their sex lives and drives at some time, if not most of the time. That's part of being human. I wanted to forgive him. But he was hurting the party. So good luck in your future endeavors, Mr. Weiner. And like they say at the bar at closing time, you don't have to go home, but ya can't stay here.
